From engagement letter to signed PDF
You have an engagement letter from the contract builder signed, with the client’s details already filled in, or your own PDF. You send it with a deadline to the contact, on its own or as the last step of a procedure after the intake form, the documents and the identity check. A workflow can also set up that procedure by itself.
Your client signs in to the client portal with a code by email and signs there. A contract from the contract builder goes into the case file with the certificate. If it changed after your client opened it, RiskResolve refuses the signature until they have read the new version. RiskResolve keeps a fingerprint of the signed contract and checks it on every download.
The electronic signature and the law
Under Article 3:15a of the Dutch Civil Code, an electronic signature has the same legal effect as a handwritten one if the method is sufficiently reliable in view of its purpose.
An engagement letter has no statutory form requirement. A simple electronic signature within the meaning of eIDAS, Regulation (EU) No 910/2014, is enough for it, as it is for declarations and other agreements without a form requirement. A signed document goes into the case file, where Article 33 Wwft requires record-keeping.
